Sorry this post is so delayed. I very much appreciate all of you who we’re present to hear Judge Zibilich’s ruling. And I also, just as much, appreciate being included in all of the prayers and meditations!!!
Yesterday Judge Zibilich granted our Motion to Suppress Identification in part, and denied it in part. He will not allow the “out of court identifications” into evidence. Nonetheless, he will allow the “in court identifications” into evidence.
Essentially, the allowance of any part of the identifications will eventually bring the out of court identifications into play. At trial, that’s the only way our defense can explain/discredit the allowance of the in court identifications. So, we’re back at square one after 2 months time…
However, we should not fret! We are filing to the Appeals Court, asking a panel of judges to not allow any of those coerced identifications into evidence.
Please contact me through email @ email@example.com if you need more clarity.
Again, I thank all of you for you faith & support! Hope to see you all at my next court date on February 3rd, @ 8:15am SHARP! Section “L” (2nd fl.) in Criminal District Court building, 2700 Tulane Ave.
